HeyGen Voice Supplemental Terms
These Voice Supplemental Terms ("Voice Terms") govern HeyGen's voice cloning, voice design, speech generation and other voice features, including Professional Voice Cloning ("PVC"), whether used on their own, in videos or through an authorized API or integration ("Voice Services"). They supplement the HeyGen Terms of Service ("Base Terms").
Your agreement is with HeyGen Technology, Inc. ("HeyGen", "we", "us" or "our"). "You" means the individual accepting these Voice Terms or the entity for which an authorized representative accepts them. Capitalized terms not defined here have the meanings given in the Base Terms.
1. Application and Priority
These Voice Terms apply when you accept them or an agreement that incorporates them. They control a conflict with the Base Terms concerning the Voice Services. The remaining Base Terms continue to apply, including plan restrictions, payment, warranties, liability, indemnity and dispute resolution.
A separately agreed enterprise agreement or other written agreement governs according to its terms. These Voice Terms apply to that relationship only if validly incorporated and do not override its restrictions on using customer data for model training. Applicable data processing agreements and international transfer clauses retain their agreed priority. Mandatory legal rights remain unaffected.
2. Permission to Create and Use a Voice
You may clone or reproduce your own voice, or another person's voice only with that person's prior, explicit and informed permission. This applies also to a designed or modified voice intended to imitate an identifiable person. The person whose voice is reproduced is the "Speaker". You must be at least 18, and you may not create or use a clone of a person under 18.
For a voice HeyGen supplies for use in the Services, you may rely on the uses HeyGen expressly authorizes under the applicable plan, license and restrictions without obtaining a separate release from the Speaker. This does not authorize extracting the voice model, creating another clone or suggesting an endorsement beyond those permissions.
Before uploading recordings or requesting a clone, you must hold all necessary rights in the recordings and obtain the Speaker's permission in writing or another verifiable recorded form. Explain that AI can generate speech the Speaker never recorded. The permission must identify the authorized user or organization, intended purposes, permitted sharing and commercial uses, any languages or contexts covered, and its duration and restrictions. Obtain further permission before materially expanding those uses.
You must provide required privacy information and obtain any separate consent required for personal or biometric data processing. Permission must cover HeyGen and its service providers processing the material to provide the requested Voice Services under the applicable agreement and notices. Your acceptance of these Voice Terms does not replace consent required from the Speaker.
Keep reliable evidence of the rights and permissions on which you rely, protect that evidence and provide it on a reasonable request from HeyGen. Owning a recording, employing the Speaker or finding a recording publicly available does not by itself authorize voice cloning or every intended use.
3. Public Figures and Other Restricted Voices
You may not clone or reproduce the voice of a celebrity, public figure or political candidate without the permissions required by Section 2 and HeyGen's prior written approval. A deceased person's voice requires documented authorization from the person or persons legally entitled to authorize the proposed use, together with HeyGen's prior written approval. Public availability or public-domain status of a recording does not by itself satisfy these requirements.
Permission or approval does not allow political campaigning, lobbying or other content prohibited by the Base Terms or the Acceptable Use and Moderation Policy. An imitator's permission does not authorize replication of the person being imitated.
4. Verification and Access
You must complete any consent or verification process HeyGen requires before creating, using or sharing a voice, including PVC. We may request the Speaker's direct participation, a consent recording or further evidence, and may restrict access while reviewing a concern. Do not falsify evidence or bypass these checks.
A successful check or the availability of a voice does not establish that every use is authorized. You remain responsible for the permissions applicable to your use. Share access to a custom voice only through features HeyGen makes available and only with users covered by the Speaker's permission and your agreement. These Voice Terms do not authorize public listing, resale or unrestricted reuse of a custom voice.
5. Permitted Use and Disclosure
The Base Terms and Acceptable Use and Moderation Policy apply to voice recordings, voice models and generated speech, including use or distribution outside HeyGen. You must not use them for fraud, scams, harassment, unlawful surveillance, deceptive impersonation, false endorsements or other prohibited content. Do not use a generated voice to defeat voice authentication or obtain unauthorized access, money or information.
Review generated speech before using it. Do not present it as an authentic recording or imply that the Speaker made or endorsed statements beyond the permission given. Clearly disclose its AI-generated nature when required by law or necessary to avoid misleading the audience. Do not remove or defeat authenticity labels or technical safeguards provided by HeyGen.
If you use generated speech in calls or messages, comply with applicable consent, identification, disclosure and opt-out requirements. A Speaker's permission to clone their voice does not establish a recipient's permission to receive a call or message.
6. Content Rights and Processing
Rights in recordings and generated output, and any commercial-use restrictions, remain governed by your applicable agreement and plan. These Voice Terms do not expand Free Plan output rights or transfer ownership of a person's voice or identity. Rights in HeyGen's underlying technology remain with HeyGen.
Creating the particular voice clone you request is distinct from using material to train or improve general models. These Voice Terms grant no additional permission for general model training, advertising, public voice-library distribution or endorsement. Any such use requires an independently valid contractual permission and compliance with applicable privacy notices, choices and law. A Speaker's permission for one purpose does not authorize another.
The HeyGen Privacy Policy, Biometric Information Privacy Notice and any applicable data processing agreement explain the relevant processing, safeguards and rights. A content license does not replace a lawful basis or required privacy consent, override a withdrawal or deletion obligation, or make identifiable voice data anonymous.
7. Withdrawal and Removal
If permission expires, is withdrawn or no longer covers the use, promptly stop affected generation and sharing, disable access within your control and notify HeyGen if assistance is needed. Honor the Speaker's request to remove affected content wherever you have published it. You must also stop using and remove content that is unlawful or unauthorized.
Speakers may report unauthorized cloning or request removal through [email protected]. Privacy, consent-withdrawal and deletion requests may be sent to [email protected]. Identify the affected voice or content and provide enough information for us to assess the request; an active HeyGen account is not required.
Retention and deletion remain subject to the applicable privacy notices, agreements and law, including applicable backup limits and lawful retention requirements. Disabling a voice is not the same as deleting its associated personal data. Removal from HeyGen may not retrieve copies already held by others, but does not limit their obligations or the Speaker's legal rights.
8. Enforcement and Changes
Subject to the applicable agreement and law, HeyGen may refuse creation, restrict or disable a voice, remove content or suspend access where permissions are missing, disputed or insufficient, or where a use violates these Voice Terms. Reports and appeals follow the Acceptable Use and Moderation Policy. An appeal does not authorize continued prohibited use.
Changes to these Voice Terms are subject to the notice, amendment and consent requirements of the Base Terms, any controlling agreement and applicable law. For questions about these Voice Terms, contact [email protected].
